Illegal Parking

2026-10-23 06:00:02

1. Definition and Legal Basis

Illegal parking (commonly referred to as "unauthorised parking") refers to an act where a motor vehicle driver breaches road traffic safety laws and regulations governing vehicle parking and temporary waiting, by parking in prohibited zones or parking improperly. Its primary legal foundation stems from Article 56 of the "Road Traffic Safety Law of the People's Republic of China" and Article 63 of the "Regulations for the Implementation of the Road Traffic Safety Law".

2. Common Forms of Illegal Parking

Under statutory provisions and law enforcement practices, the following scenarios constitute illegal parking:

  • Parking in prohibited zones: Parking along road stretches designated with no-parking signs or solid yellow road markings.

  • Obstruction of designated areas: Parking on pedestrian walkways, tactile pavements, fire access routes, bus bays/stops, petrol stations, within 50 metres of junctions, on bridges, inside tunnels, and other restricted zones.

  • Improper parking methods: Parking against the flow of traffic within bays, straddling or crossing parking lot lines, and hogging multiple parking bays with a single vehicle.

  • Driver leaving the vehicle unattended: The driver vacating the vehicle along road stretches where only brief, temporary drop-offs/waiting are permitted.

3. Penalty Structure

Based on regional enforcement practices, penalties generally fall into two categories:

Offence Category Penalty Details (Taking Beijing and Tianjin as examples) Legal Grounds
Standard illegal parking Fine of 200 RMB, 0 demerit points Improper vehicle parking obstructing other road users and pedestrians
Violation of no-parking signs/markings Fine of 200 RMB, 3 demerit points Parking along road sections with clear no-parking signage or road markings

4. Enforcement Workflow (Strictly Enforced vs Standard Road Sections)

Enforcement standard operating procedures differ depending on the zoning of the road section:

  • Strict enforcement zones: If the driver is present, they will be ordered to move the vehicle immediately; refusal to comply leads to an immediate summon. If the driver is absent, officers will photograph the offence on the spot and issue an "Illegal Parking Notice" on the vehicle.

  • Non-strict enforcement zones: If the driver is absent, the vehicle owner will first receive an alert via the "Traffic Management 12123" mobile app or SMS. If the vehicle is not moved within 10 minutes, a summon notice will be issued and penalised. No compound or penalty will be imposed if the driver returns and drives off within the 10-minute grace window.

5. Hazards and Repercussions

  • Impeding traffic flow: Illegal parking encroaches upon active road space, creating bottlenecks that trigger heavy congestion.

  • Endangering public safety: Obstructing sightlines creates dangerous blind spots, potentially leading to sudden pedestrian knockdowns and collisions; blocking emergency access lanes and rescue corridors delays critical response times.

  • Marring urban landscape: Disrupting the orderliness and aesthetic appeal of city streetscapes.

6. Industry Trends

  • Expansion of automated enforcement: Widespread deployment of automated traffic enforcement cameras and mobile patrol vehicle cameras enables round-the-clock digital evidence recording and automated summon issuance.

  • Adoption of flexible, driver-centric enforcement: Authorities across various jurisdictions are increasingly adopting "first-time minor offence warnings" and SMS-first reminders, striking a practical balance between strict compliance and public convenience.
