Road Traffic Accident Social Assistance Fund

2026-10-22 01:00:01

The Road Traffic Accident Social Assistance Fund (referred to as the "Assistance Fund") is a statutory government special fund established to disburse advance payments for funeral costs as well as partial or full emergency medical and resuscitation expenses for road accident victims suffering personal injury or death. Operating as a state-backed financial safety net, the fund is designed to address critical situations where accident victims are unable to secure timely emergency treatment due to hit-and-run incidents, uninsured vehicles without mandatory motor insurance, or the at-fault party's inability to pay for immediate medical care.

Core Statutory Principles and Qualifying Conditions for Advance Payment

The establishment of the Assistance Fund is guided by the principles of "people-first, life-saving emergency relief, and advance disbursement with subsequent recovery", with its activation strictly governed by statutory criteria.

Under relevant administrative regulations and guidelines, following a motor vehicle road accident where emergency treatment is required and the vehicle owner or liable party is financially incapable of covering the costs, the Assistance Fund may advance partial or full emergency medical expenses under any of the following circumstances:

The motor vehicle involved is not covered by compulsory motor traffic accident liability insurance;

The incident is a hit-and-run involving a motor vehicle;

The required emergency medical expenses exceed the statutory liability limit of compulsory motor insurance;

Other special circumstances requiring financial advance as provided by law and administrative regulations.

Scope of Coverage and Application Procedures

The payout limits and application workflows for the Assistance Fund adhere to strict statutory procedures to ensure the transparent, efficient, and secure utilisation of funds:

Statutory Scope of Coverage:

Emergency Medical Expenses: Reasonable medical and resuscitation costs incurred by the victim at medical facilities (typically covering treatment within the first 48 hours of emergency care, subject to local implementation guidelines).

Funeral Expenses: Statutory funeral costs advanced where the victim sustains fatal injuries and the liable party cannot be identified or is unable to bear the expenses.

Application and Review Workflow:

Application by Medical Institutions: In eligible emergency scenarios, medical institutions providing emergency treatment to the victim are authorised to submit a formal written application directly to the fund management body for advance medical payments.

Fund Assessment and Disbursement: Upon receipt of the application, the fund management body conducts a rigorous review of all supporting documents. Once approved, the funds are disbursed directly into the designated bank account of the medical institution.

Recovery Mechanism and Legal Liabilities

The Assistance Fund is not an unconditional grant or a permanent financial bailout; it functions as a statutory advance with mandatory recourse provisions:

Statutory Cost Recovery from Liable Parties: Following the disbursement of funds, the management body retains the legal right of subrogation to recover the advanced sums from the liable parties involved (including the vehicle owner, driver, or legally liable entities). The liable parties are legally obligated to reimburse the fund. Failure to comply will result in recovery actions through civil litigation and formal judicial enforcement.

Prevention of Abuse and Fraudulent Claims: Any attempt by organisations or individuals to obtain fund payouts through fraudulent misrepresentation—such as staged accidents or falsified medical reports—is strictly prohibited. Offenders will face full asset recovery alongside administrative and criminal prosecution, ensuring these essential public resources remain safeguarded for genuine life-saving emergencies and vulnerable road users.
