Dedicated Clauses for New Energy Vehicle Insurance refer to the commercial motor insurance framework developed by the Insurance Association of China specifically for new energy vehicles (NEVs), officially rolled out for trial implementation in December 2021. Tailored to address the distinct risk profile of NEVs centred on the high-voltage traction battery, these terms incorporate the "three-electric" powertrain systems, charging scenarios, and private EV charging units into the scope of coverage, marking the official departure of NEV insurance from conventional internal combustion engine (ICE) policy frameworks.
Fundamental differences exist between NEVs and conventional petrol or diesel vehicles in terms of mechanical architecture and operational risk scenarios. Traditional motor insurance cannot adequately cover risks unique to NEVs: the traction battery alone accounts for 40% to 60% of total vehicle value, introducing new risks such as battery fires and thermal runaways; electrical grid fluctuations during charging can cause severe vehicle damage; and private home charging units are also exposed to accidental loss. Consequently, rapid technological advancements created an urgent need for dedicated, bespoke insurance products within the industry.
The dedicated clauses explicitly apply to passenger cars and commercial vehicles adopting advanced powertrains that rely entirely or predominantly on alternative energy sources, covering three main categories:
Plug-in Hybrid Electric Vehicles (PHEVs, including Range-Extended EVs)
Motorcycles, tractors, and special-purpose vehicles are excluded from these clauses. Following enforcement, all newly issued and renewed policies for NEVs must adopt these dedicated terms, superseding standard commercial motor vehicle policies.
The dedicated framework consists of three standalone primary coverages: NEV Own Damage Insurance, NEV Third-Party Liability Insurance, and NEV On-Board Passenger & Driver Liability Insurance.
Key coverage enhancements under the primary policies include:
Inclusion of "Three-Electric" systems under coverage. The terms explicitly itemise direct loss coverage for the battery and energy storage system, drive motor and transmission assembly, and electronic control modules, resolving historical ambiguities over claims for core high-voltage components.
Inclusion of "fire and combustion" as accidental losses. Vehicle loss resulting from fire or combustion is formally categorised under accidental damage, establishing clear protection against spontaneous combustion risks.
Full coverage across all operational states. Coverage transcends the traditional limitation where claims were only payable during driving, providing comprehensive protection across four distinct states: driving, parked, charging, and stationary operation.
Complete protection for factory-fitted equipment. Beyond the three-electric powertrain, factory-installed autonomous driving and advanced driver assistance systems (ADAS) hardware, such as LiDAR sensors and cameras, are fully covered under the own damage policy.
Three specific add-on covers have been introduced to address unique NEV operational risks, purchasable as riders alongside the corresponding primary policy:
External Power Grid Failure Loss Endorsement: Covers direct vehicle damage caused by external power grid faults (such as voltage surges or transmission/distribution failures) during charging, eliminating a major protection gap during EV charging sessions.
Private EV Charger Loss Endorsement: Covers standard-compliant home charging wallboxes/units against physical damage caused by natural disasters, accidents, theft, or third-party vandalism. The agreed sum insured is determined between policyholder and insurer, ranging from RM2,000 to RM20,000.
Private EV Charger Third-Party Liability Endorsement: Covers legal liability for third-party bodily injury, death, or property damage resulting from the operation of a private charging unit, safeguarding owners against third-party claims.
The dedicated clauses specify that the following common scenarios are strictly excluded from policy liability:
Natural battery capacity degradation: Loss of battery capacity resulting from regular long-term use constitutes normal wear and tear, which must be covered under the manufacturer's warranty.
External power grid failure losses: Without purchasing the dedicated grid failure rider, losses sustained from grid irregularities during charging are strictly non-claimable.
Manufacturing defects and unauthorised modifications: Losses arising from inherent build defects or unauthorised aftermarket electrical wiring modifications remain strictly non-payable.
During the initial rollout of the dedicated clauses, NEV insurance premiums generally saw an upward adjustment. Industry data indicated premium hikes of around 30% to 40% for selected models, attributed to higher claim frequencies and substantial repair and replacement costs. In terms of benchmark tariffs, base rates for third-party liability and own damage cover decreased by roughly 0.8%, allowing approximately 80% of vehicle owners to enjoy reduced premiums; however, premium rates for premium models priced above RM250,000 and brands with high claim payout ratios recorded noticeable increases.
